Although the conflicting situation regarding the rights of the nominee and the legal heirs is settled by this decision, a comprehensive and acceptable definition of the nominee is still required. And for this, the legislative body should act with accordance with the direction of the High Court and make necessary amendment to the respective laws.
The landmark judgment on the Constitutionality of 16th Amendment by the Appellate Division of Bangladesh is important for every student of constitutional law. In this judgment, the Appellate Division restored Judicial Council and scraped the 16th amendment which had empowered the Parliament to dismiss Supreme Court judges.
The scope of trade secrets is much wider compared to that of patents. There is a qualitative test for patent protection but any information which is not knows to the general public and is of advantage for the business can be protected as trade secrets. Although Article 39 of the TRIPS Agreement 1995 set out international standards, for protecting trade secrets, were established, yet patent holds more statutory legal protection.
The modern era of information and technology has turned our personal data into a valuable commodity. But unfortunately, the evolution of law protecting such commodity has failed to keep up with the ever-changing technologies. As a result, a lot of confusion has arisen over the past few years and many opportunists took advantage of this confusion by stealing and selling our personal data without informing us about our identity theft.
This research paper is about the problems of the present enforcement mechanism existing in South Aisa and the probable solutions.
